Oral Argument was held Wednesday in Knife Rights’ Ninth Circuit appeal of the ludicrous District Court decision in our lawsuit challenging the Federal Switchblade Act on Second Amendment grounds. You can listen to the audio or view the video or the Ninth's website.
The panel of two Clinton and one Biden appointees was only revealed after the deadline for submittal of amicus briefs that the panel requested. Given the generally anti-Second Amendment bias of the Ninth, this oral argument was likely not much more than performance theater preface to another twisted anti-2A decision that ignores the Supreme Court's clear instructions in Bruen. Nevertheless, even with a hostile panel of judges, we held our own and made it clear that the undisputed record was in our favor. These are protected arms, and the State did not meet its burden of justifying the ban through Heller and Bruen's historical analysis. We would love to be surprised by a decision that actually upholds the law of the land, but we are not holding our breath.
Knife Rights' attorney John Dillon of Dillon Law Group said, "It is clear that switchblades are protected arms under the Second Amendment. The State's extra conditions and qualifications have no basis in law or fact, and the state entirely failed to justify this ban, as the record clearly shows that switchblades are in common use and not both dangerous and unusual. We can only hope the Ninth Circuit will faithfully apply the Supreme Court's clear instructions to this case."
